(d) The foregoing provisions of Section 4 are for the benefit of Sporting Sites Worldwide Ltd, its subsidiaries, affiliates and its third party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf.

5. Disclaimer of Warranty; Limitation of Liability

(a) User expressly agrees that use of Sporting Sites Worldwide Ltd is at User's sole risk. Neither Sporting Sites Worldwide Ltd, its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that Sporting Sites Worldwide Ltd will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of Sporting Sites Worldwide Ltd, or as to the accuracy, reliability or content of any information, service, or merchandise provided through Sporting Sites Worldwide Ltd.

(d) Sporting Sites Worldwide Ltd does not limit its liability for death or personal injury arising from its negligence or from the negligence of its employees acting in the course of their employment. 7. Indemnification

8. Termination

Either Sporting Sites Worldwide Ltd or User may terminate this Agreement at any time. Without limiting the foregoing, Sporting Sites Worldwide Ltd shall have the right immediately to terminate User's Account in the event of any conduct by User which Sporting Sites Worldwide Ltd, in its sole discretion, considers to be unacceptable, or in the event of any breach by User of this Agreement. The provisions of Sections 4(b), 4(c), 4(d), 5, 7, 9 and this Section 8 shall survive termination of this Agreement.

9. Trademarks

Sporting Sites Worldwide Ltd and all logos are trademarks of Sporting Sites Worldwide Ltd. All rights reserved. All other trademarks appearing on Sporting Sites Worldwide Ltd are the property of their respective owners.

10. Miscellaneous

This Agreement and any operating rules for Sporting Sites Worldwide Ltd established by Sporting Sites Worldwide Ltd constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written oral agreements between the parties with respect to such subject matter. This Agreement is governed by and construed in accordance with the laws of England and Wales and the parties submit to the exclusive jurisdiction of the English Courts. If any provision(s) of the Service Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. Sporting Sites Worldwide Ltd failure to exercise or enforce any right or provision of the Service Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed by Sporting Sites Worldwide Ltd in writing. No refunds will given for any days on which data is either not available at all or on which data is not available until a time after the ‘best endeavours’ time quoted.

The Napchecker services covers tips from a range of UK and Irish newspapers. The range of newspaper covered may change at any time and without notice. Sporting Sites Worldwide Ltd. at no time guarantee coverage of tips from any newspaper or specific tipsters. The subscription paid to the site is for the avoidance of any doubt not based on guaranteeing access to any specific newspaper or tipster information.
